LIABILITY WAIVER

**This document has been carefully drafted and complies with current legal standards, reflecting our commitment to transparency and integrity in our relationships with our clients.**

I acknowledge and assume all risks and consequences associated with my participation in and/or receipt of any services provided by the Artist.

I acknowledge that I received and completed the Post-Treatment Care Form provided by the Artist prior to my appointment, and I confirm that I understand the post-treatment care instructions included in this form. I agree to follow the post-treatment care instructions outlined in this form and understand that the Artist shall not be held liable for any complications resulting from my failure to comply with these instructions.

I acknowledge that the quality of the final tattoo may vary depending on various factors such as skin quality, healing, and other elements beyond the Artist’s control. Therefore, the Artist cannot be held responsible for aesthetic issues or any subjective dissatisfaction the client may have regarding the completed tattoo.

Accordingly, tattoo services are non-refundable. Following the healing process, if a touch-up is required, the cost is $30.00 plus applicable taxes.

I acknowledge and accept that allergic reactions may occur as a result of receiving a tattoo. I declare that I have informed the Artist of any allergies affecting me. The Artist is hereby released from any liability in the event of allergic reactions.

I acknowledge that the Artist, as a professional, follows all health and safety standards in force in Quebec to prevent infections or complications. However, I understand that zero risk does not exist. Consequently, I understand that the Artist’s liability in the event of an infection or complications is limited to damages directly caused and proven to result from the Artist’s fault.

I confirm that I am sufficiently prepared, informed, and/or trained to participate in and/or receive these services, such as receiving a tattoo or laser treatment. I acknowledge that I have been informed of the inherent risks associated with the services offered by the Artist.

I certify, as indicated in my pre-appointment health assessment, that I am in good physical condition and that there are no health-related reasons or conditions preventing me from participating in and/or receiving services provided by the Artist. I also certify that no qualified healthcare professional has advised me against participating in these activities.

I confirm that I have provided, signed, and understood the pre-appointment health assessment given to the Artist prior to the tattoo procedure, and that it reflects, to the best of my knowledge, my current state of health.

I understand that it is my responsibility to immediately inform the Artist of any changes or updates to my initial health assessment prior to each of my appointments in order to ensure my health and safety.

I understand that the services performed by the Artist are independent and not affiliated with any other companies or representatives, including during events. Therefore, the Artist cannot be held responsible for any complications involving the clientele of other companies.

I understand that the Artist is not responsible for any defects or damages resulting from a tattoo performed by another tattoo studio or tattoo artist, as the Artist cannot be held liable for the actions of individuals or businesses that are not under their control.

I understand that during events taking place outside of the Roy Tatouage & Laser studio, located at 535 Boulevard Laurier Ouest, Sainte-Madeleine, Quebec J0H 1S0, the Artist is not responsible for external factors that may affect the tattoo procedure or the required post-treatment care.

I acknowledge and accept that tattooing involves inherent risks that are voluntarily assumed. By signing this waiver, I declare that I have been informed of these risks and release the Artist from any liability arising from the tattoo procedure.

I acknowledge and understand that the Artist performs tattoo procedures in accordance with industry standards and recognized professional practices within the tattoo industry. Consequently, I accept the methods and procedures used by the Artist in the performance of tattoo services.

I acknowledge and accept that the Artist reserves the right to refuse to perform any tattoo service if the Artist determines that the conditions for performing the tattoo are not optimal or if the Artist believes that I am not in a suitable condition to receive a tattoo.

I acknowledge that any provision contained herein that is prohibited or unenforceable shall be ineffective only to the extent of such prohibition or unenforceability, without invalidating the remaining provisions herein.

I acknowledge that I have read and agree to this liability waiver. I also acknowledge that it may be used by the Artist in connection with my participation in and/or receipt of the Artist’s services.
